Terms and conditions

Draft – to be reviewed by a chamber of commerce or lawyer before publication.

This is a translation for your convenience. The German version is legally binding.

1. Scope and provider

These terms apply to all orders of digital products in the Margenblick shop of Lukas-Domenik Sonnenfeld, Anschrift siehe Impressum, Germany, email: sunfieldshops@gmail.com (“we”). A consumer is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 BGB). We supply the countries offered on the order page; we do not supply consumers in the United Kingdom.

2. Conclusion of the contract

(1) The presentation of the products is not a binding offer. (2) The order summary shows the product, price and delivery method; via “change” you can return to the product page and correct your selection. (3) By clicking one of the payment buttons “Order with obligation to pay – PayPal” or “Order with obligation to pay – card, Apple Pay, Google Pay, Klarna, SEPA & more” you submit a binding offer and are forwarded to PayPal or Stripe. (4) The contract is concluded when you complete the payment at PayPal or Stripe. (5) We then send you a contract confirmation by email with these terms, the information on the right of withdrawal, confirmation of your consent to early performance and the download link. We store the contract text; you receive it with the confirmation. The contract language is German.

3. Prices

All prices are final prices in euros. VAT exempt under § 19 of the German VAT Act (small business scheme) – no VAT is charged. There are no shipping costs.

4. Payment

Payment is made, at your choice, via PayPal (depending on PayPal’s offer, card payment without a PayPal account is also possible) or via the payment service Stripe (Stripe Payments Europe, Ltd., Dublin) using the payment methods offered there, e.g. card, Apple Pay, Google Pay, Klarna or SEPA Direct Debit. If you pay via Stripe, you enter your payment details only on Stripe’s payment page; the purchase price is due immediately upon ordering.

5. Delivery

We send the download link to the email address you gave PayPal or Stripe; delivery time innerhalb von 24 Stunden, meist schneller. The link is valid for [30] days; after that we will send you a new link free of charge on request. Please back up the files after downloading.

6. Right of use

You receive a simple, unlimited, non-transferable right of use for yourself or your own business in accordance with the licence. Passing on and reselling are not permitted.

7. Right of withdrawal

Consumers have a right of withdrawal as set out in the information on the right of withdrawal. It expires early if, with your express consent and acknowledgement, we begin performance before the withdrawal period ends and have provided you with the contract confirmation (§ 356(5) BGB).

8. Rights in case of defects and updates

The statutory rights for digital products apply (§§ 327 et seq. BGB). We provide updates required to keep the products in conformity with the contract (§ 327f BGB) and inform you by email. The fee templates reflect public information as of the date stated; later fee changes by providers are not a defect.

9. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the German Product Liability Act. For slight negligence we are only liable for breach of essential contractual obligations, limited to the typical, foreseeable damage. The products are calculation aids and not tax, legal or financial advice.

10. Dispute resolution

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

11. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as mandatory consumer protection provisions of the country of your habitual residence do not prevail.
